Terms of Use

Welcome to KiroPhotos (Chinese name: "时光相册"; hereinafter referred to as the "App") and its related services.

These Terms of Use (the "Terms") constitute an agreement between you and the operator of the App, Peng Zong (彭棕), an independent developer (the "Developer," "I," "me," or "my"), regarding your download, installation, and use of the App and its related services. Before using the App, please read and fully understand these Terms, particularly the provisions shown in bold concerning paid services, automatic renewal, data management, limitations of liability, service changes, and dispute resolution. Please also read the KiroPhotos Privacy Policy.

When the App asks you to accept these Terms, clicking "Agree," purchasing a paid service, or continuing to use the App means that you have read, understood, and agreed to be bound by these Terms. If you do not agree to any part of these Terms, stop using the App. Nothing in the foregoing excludes or limits any right that applicable laws and regulations prohibit standard terms from excluding or limiting.

Important Information

1. The App is a local photo management and editing tool, not a cloud storage or backup service. Data such as photo indexes, face and person features, photo semantic features, search records, workout routes, editing settings, and imported LUTs is stored primarily on your device. You are responsible for properly backing up important photos, videos, LUTs, and other files.
2. The App can modify the system photo library. Actions such as deleting photos, marking favorites, managing albums, changing dates or locations, and saving edited results may change or delete content in the system photo library. Confirm the affected content and expected result before proceeding. Deletions are subject to the iOS system confirmation process and the rules of Recently Deleted.
3. Some features depend on third-party services. iCloud Photos, Apple Maps and geocoding, Apple Health, Apple Translation, the App Store, StoreKit, and Feishu online documents used by some App versions are provided by the relevant third parties. Their availability and data-processing practices are governed by the third parties' terms.
4. Subscriptions renew automatically. Monthly and annual memberships are auto-renewable subscriptions. Unless you cancel at least 24 hours before the end of the current subscription period, Apple may renew and charge for the subscription under App Store rules. Lifetime membership is a one-time purchase and does not renew automatically, but purchasing it does not automatically cancel an existing monthly or annual subscription.
5. No account registration is required in the current version. The App does not provide its own account registration, sign-in, or account deletion functions. Purchased entitlements are associated with the Apple Account used for the App Store, and restoring a purchase requires the account originally used to make it.
6. Person recognition, natural-language search, and workout routes are assistive features. Person clustering, semantic photo matching, and route-derived workout information may omit, misidentify, or mismatch results. They are not intended to establish real-world identity, authenticate identity, diagnose a medical condition, or support a safety-critical decision.
7. Footprints can record location in the background. Independent footprint recording and Apple HealthKit workout access are separate, optional features. Manual recording requires only "While Using the App" access and may continue in the background or while locked after starting in the foreground, subject to system limits. Granting "Always" access enables automatic background recording, which you can turn off in footprint settings. Pausing or ending manual recording does not automatically disable automatic background recording. Route matches are written to photo locations only after you confirm applying them.

1. Parties, Scope, and Acceptance

1.1 These Terms apply when you download, install, or use the App on an iPhone or iPad, including your use of its basic features, membership features, online documents, and other related services.

1.2 The operator is:

1.3 You must have the legal capacity appropriate for using the App and entering into these Terms. A person who lacks or has limited civil capacity must have a parent or legal guardian read and accept these Terms and provide guidance on use.

1.4 These Terms, the KiroPhotos Privacy Policy, the product descriptions displayed on paid-service screens, and any rules that I lawfully publish and expressly identify as part of these Terms together constitute the entire agreement between you and me regarding the App. If a specific paid-service screen conflicts with these Terms regarding transaction details such as product name, price, duration, trial, or renewal method, the screen and App Store information presented when you confirm the purchase will prevail, unless otherwise required by law.

2. Services and How They Are Provided

2.1 The App is a tool for browsing, organizing, and editing photos and videos and managing memories. Features currently available may include:

• Browsing, filtering, sorting, and generating statistics for photos and videos in the system photo library;
• Viewing technical information about photos and videos, including capture date, location, camera, lens, and exposure;
• Managing favorites and albums and duplicating, deleting, sharing, or exporting photos and videos;
• Adjusting photo dates and locations and applying cropping, rotation, filters, LUTs, and frames;
• Viewing and searching for places on a photo map and applying place information to photos;
• Creating, editing, and managing memories;
• Detecting faces and person appearance in photos on the device, generating feature representations, clustering photos that may depict the same person, and allowing you to name, merge, split, hide, and find people;
• Generating photo semantic features and a search index on the device to find and categorize photos using natural-language descriptions and combined conditions such as place, person, and time;
• After you grant "While Using the App" location access and manually start recording, using Apple Core Location for precise footprints with pause, resume, and stop controls; enabling automatic background recording after you grant "Always" access, with a separate off control; displaying historical routes, distance, speed, and trip retrospectives; and providing Lock Screen or Dynamic Island Live Activities where permitted by the system;
• With your authorization, using Apple HealthKit for read-only access to workouts and workout routes to display workout retrospectives, derive distance, pace, and segment information locally, match photos taken during a workout, and restore photo locations after you confirm; you can also skip HealthKit authorization and match photos using existing local footprints alone;
• Providing other basic or membership features displayed in the App.

2.2 Specific features, interfaces, membership entitlements, and supported devices may vary by app version, system capabilities, region, language, device model, and authorization status. The features shown in the version of the App you use determine actual availability.

2.3 Face and person analysis, photo semantic feature generation, and semantic matching are performed primarily on your device using models included with the App. To analyze a photo stored only in iCloud, the App may, depending on your settings, ask Apple through PhotoKit to download an appropriate version of the asset. A non-Chinese search term may use system translation capabilities provided by Apple, and the system may download language resources when necessary. The App does not upload photos, face or person features, photo semantic features, search terms, or health and workout data to servers operated by the Developer.

2.4 The following features require network access or an online capability provided by Apple: downloading iCloud photos or videos, loading maps, searching for places, reverse geocoding, downloading system translation language resources, retrieving or purchasing App Store products, restoring purchases, and viewing online legal and help documents. You are responsible for network charges, device costs, and fees lawfully charged by Apple or other third parties.

2.5 I do not guarantee that the App is compatible with every device, operating system version, or third-party service. You should use a compatible device and system identified on the App Store product page and install necessary system and app updates in a timely manner.

3. System Permissions and Device Data

3.1 To provide relevant features, the App may request photo-library access, location while using the App for map positioning and manual footprint recording, "Always" location access for automatic background footprint recording, read-only Apple HealthKit access, and network access. After you first grant While Using access through footprints, the App requests "Always" access; declining the upgrade does not prevent manual recording. Footprint recording and health-data access are authorized separately; refusing HealthKit access does not affect authorized footprint recording. Permission purposes and personal information processing rules are described in the KiroPhotos Privacy Policy and the relevant system permission notices.

3.2 You may refuse or withdraw nonessential permissions at any time. A feature that relies on a refused or withdrawn permission may become unavailable, but other features that do not rely on it will not be affected.

3.3 The App does not decide on your behalf whether photo, health, or location data is appropriate for processing. Before batch deletion, writing a date or location, matching a workout route, overwriting an edit, or exporting content, you should verify the scope and result of the operation.

3.4 To provide person, search, footprint, and workout-retrospective features, the App may store face location and quality information, face and person-appearance feature vectors, person clusters and names, photo semantic features and indexes, search conditions and history, footprint coordinates and times, location accuracy, available altitude and speed, recording sessions and state, health-workout routes and route-derived information, associated photo identifiers, and map snapshots in the App's sandbox. These are local data generated from photos, device location, or health data. See the Privacy Policy for processing and retention details.

3.5 You can pause new image-recognition or natural-language indexing tasks in the App's settings and withdraw Health read permission in the Health app. Pausing a task, hiding a person, or hiding a workout route does not automatically delete local data generated earlier; rescanning may rebuild the relevant index. Uninstalling the App generally deletes local indexes, memories, person and semantic features, search records, workout routes, settings, caches, and imported files from the App's sandbox. It does not delete content already saved to the system photo library, Files app, another app, or a cloud service. Clearing the cache deletes only cached files and is not equivalent to deleting all App data.

3.6 Automatic background recording and manual precise recording have separate controls. Granting or regranting "Always" access enables automatic background recording. After you turn it off, reopening the App alone will not turn it back on. After you pause or end manual recording, footprints may continue to be recorded if automatic background recording remains enabled. Turning off automatic background recording does not end an active manual recording. To stop all footprint recording, turn off automatic background recording and end manual recording, or set location access to "Never" in system settings. Downgrading only to "While Using the App" stops automatic recording but does not stop an active manual recording. Leaving the screen, disabling Live Activities, or locking the device does not stop recording. Recording preferences and sessions may remain stored locally, and enabled recording may resume when you reopen the App or restore permission.

3.7 The App requests HealthKit read access only to workouts and their associated routes, not to other independent health data types or write access. It does not add, modify, or delete workouts in the Health app. Revoking health access, hiding a workout retrospective, or deleting a source workout does not guarantee automatic removal of existing local snapshots and organization settings. The App does not infer deletion solely from absence in a health query. Turning off footprint recording or clearing the cache also does not delete tracks or health-workout snapshots.

3.8 Footprint and workout-route matching estimates locations from photo capture times and available route points and cannot guarantee recovery of the actual capture location. Verify the affected photos, times, and coordinates before confirming a write. Once confirmed, coordinates become photo location metadata and may synchronize according to your iCloud Photos settings or be disclosed to recipients when sharing or exporting with location information. Revoking location or health access does not undo previously confirmed photo changes.

4. Software License and Restrictions

4.1 Subject to your compliance with these Terms, applicable law, and App Store rules, I grant you a limited, nonexclusive, nontransferable, and nonsublicensable license to install and use the App on compatible Apple devices that you own or control.

4.2 The App is licensed, not sold, and no intellectual property rights are transferred to you. Unless mandatorily permitted by law, expressly permitted by an open-source license, or separately authorized by me in writing, you must not:

• Reverse engineer, decompile, disassemble, or otherwise attempt to obtain the App's source code;
• Remove, obscure, or modify any trademark, copyright, rights notice, or technological protection measure in the App;
• Copy, rent, lease, lend, sell, sublicense, distribute, or otherwise make the App or membership entitlements available to a third party;
• Without authorization, extract, package, resell, or use the App, its interface design, built-in LUTs, frames, templates, or other materials to develop a substantially similar competing product;
• Circumvent membership checks, purchase verification, access controls, or other security mechanisms.

4.3 Open-source components included in the App are governed by their respective open-source licenses. If these Terms conflict with an applicable open-source license regarding a component, that open-source license will prevail for the component.

5. Paid Services and Membership Rules

5.1 Membership Types and Entitlements

5.1 The App may offer monthly membership, annual membership, and a one-time lifetime membership. Membership may include batch or professional frames, professional LUTs, LUT importing, applying workout route matches to photos, and other membership features introduced later. Specific entitlements, prices, and conditions are determined by the in-app purchase screen and App Store product page presented at the time of purchase.

5.2 Membership entitlements are associated only with the Apple Account used to complete the purchase and the results of StoreKit verification. On devices that meet Apple's requirements, you can use the original purchasing Apple Account and Restore Purchases to restore valid entitlements. I do not require you to register a separate App account.

5.2 Monthly and Annual Auto-Renewable Subscriptions

5.3 Monthly and annual memberships are auto-renewable subscriptions. After you confirm a purchase, Apple will charge your Apple Account.

5.4 Unless you cancel at least 24 hours before the end of the current subscription period, the subscription will automatically renew under App Store rules, and Apple may charge you for the next period within 24 hours before the current period ends. The renewal price is the price displayed or communicated to you by the App Store.

5.5 You can manage or cancel a subscription in iOS under Settings > Apple Account > Subscriptions. Unless Apple determines otherwise, membership entitlements generally continue until the end of the paid subscription period after cancellation. Deleting the App, clearing local data, or purchasing lifetime membership does not automatically cancel an existing subscription.

5.3 Free Trials

5.6 Users who meet Apple's eligibility requirements may receive a seven-day free trial of annual membership. Apple determines eligibility. Unless you cancel at least 24 hours before the trial ends, the annual membership will automatically renew and Apple will charge the price shown on the purchase screen.

5.7 Trial availability by region, eligibility, duration, and conversion rules are determined by the App Store purchase confirmation screen. An Apple Account may be eligible for only one trial, and Apple determines eligibility under its rules.

5.4 Lifetime Membership

5.8 Lifetime membership is a one-time, non-consumable purchase that does not renew automatically. Subject to your compliance with these Terms, it grants you ongoing use, without a fixed expiration date, of the lifetime membership features listed on the purchase screen, including future membership feature updates that the purchase screen promises to lifetime members.

5.9 "Lifetime" means that the entitlement itself does not expire after a fixed period. It does not mean that the App, every online service, every third-party service, or every future operating system will remain available or compatible forever. It also does not include a separate product introduced in the future, a wholly new service expressly offered for a separate fee, or an entitlement not listed on the purchase screen. I will not revoke a verified lifetime membership solely because of a price change. If applicable law, platform rules, or product discontinuation requires the termination of core paid services, I will fulfill applicable obligations regarding notice, remedies, and consumer protection.

5.10 If you have an active monthly or annual subscription when you purchase lifetime membership, the existing subscription will not be canceled automatically. To avoid further charges, cancel it yourself in Apple's subscription settings.

5.5 Payment, Refunds, and Price Changes

5.11 Product display, ordering, payment, invoices or receipts, refunds, subscription management, and purchase restoration are handled by the Apple App Store and governed by the Apple Media Services Terms and related policies. I do not collect your bank card number, payment password, or Apple ID password.

5.12 To request a refund, use a refund channel provided by Apple. Apple will process the request under its policies and applicable law. Digital goods are not necessarily nonrefundable in every circumstance. These Terms do not limit any right to a refund, contract rescission, or other consumer right granted to you by law.

5.13 I may change future purchase or subscription prices. A price change for a one-time purchase does not retroactively affect a completed transaction. Subscription price changes are implemented under Apple's notice, confirmation, and effective-date rules.

6. User Content, Exported Creations, and Material Rights

6.1 "User Content" includes photos, videos, person names, search terms, memory titles and descriptions, LUT files, and other content that you read, edit, create, import, export, or share through the App. You or the relevant rights holder retain all lawful rights in User Content. Your use of the App alone does not transfer ownership of User Content to me or grant me permission to use it, or face, person-appearance, semantic, location, health, or other data derived from it, for advertising, marketing, model training, behavioral profiling, or public distribution.

6.2 The App processes User Content locally according to your actions, photo-library authorization, and feature settings. When image recognition or natural-language search is not paused, related analysis may proceed incrementally in the foreground or in system-permitted background tasks. When you use a feature that depends on iCloud, maps and geocoding, Apple Translation, the system share sheet, or another third-party service, the relevant data is processed by that service as necessary for the feature. See the Privacy Policy for details.

6.3 You must ensure that you have lawful rights in, or necessary authorization for, any content you process, edit, export, or share and must comply with applicable laws concerning intellectual property, likeness and publicity rights, reputation, privacy, personal information protection, and other matters. You are legally responsible for unlawfully processing or sharing another person's content, except to the extent that I am legally responsible for my own conduct.

6.4 You may use creations generated or exported through the App for lawful personal or commercial purposes, but you are responsible for confirming the permitted scope of the original content, fonts, logos, third-party materials, and other elements. Unless otherwise stated on a purchase screen, in a material description, or in an applicable license, you must not separately extract, copy, sell, redistribute, or make available for download any built-in LUT, frame, template, graphic, or other App material as a standalone asset.

6.5 After you select a third-party app, contact, or storage location through the iOS system share sheet, your selected recipient processes the content. Confirm the recipient, content, and permissions before sharing.

7. User Conduct

7.1 You must comply with the laws and regulations of the People's Republic of China and the laws applicable where you are located. You must not use the App for unlawful activities or to infringe another person's lawful rights and interests.

7.2 You must not use the App to create, process, or distribute content prohibited by law, including content that endangers national security, undermines national unity, damages national honor or interests, incites ethnic hatred or discrimination, promotes cults or feudal superstition, spreads rumors that disrupt social order, is obscene or pornographic, relates to gambling, promotes violence or terrorism, incites crime, insults or defames others, or infringes intellectual property, likeness, reputation, privacy, or personal information rights.

7.3 You must not:

• Interfere with, damage, or attack the security or normal operation of the App, the App Store, Apple services, or related networks;
• Access another person's device, photo library, health data, account, system, or network without authorization;
• Use vulnerabilities, automated tools, or other means to circumvent purchase verification, permission controls, or feature restrictions;
• Impersonate another person, make fraudulent purchases, abuse refund procedures, or otherwise harm the lawful rights and interests of me, Apple, other users, or third parties;
• Violate the software-use restrictions in Section 4 of these Terms.

7.4 The current version does not provide public content publishing, comments, or a social community and does not receive your photos or videos for content moderation. If you share content on a third-party platform, you must also comply with that platform's rules.

8. Intellectual Property

8.1 Intellectual property rights in the App's software code, interface design, icons, trademarks, logos, copy, built-in LUTs, frames, templates, and other materials belong to the Developer or the relevant rights holder under applicable law. All rights not expressly granted in these Terms are reserved.

8.2 You retain the applicable rights in original photos, videos, memory content, imported LUTs, and exported creations that you lawfully own. These Terms do not alter the existing allocation of rights between you and any third party.

8.3 Apple, iCloud, App Store, HealthKit, MapKit, Feishu, and other third-party names and marks appearing in the App belong to their respective rights holders. Reference to a third-party product or service does not mean that I acquire or grant rights in the relevant trademark.

8.4 If you believe content in the App infringes your lawful rights, contact me using the details in Section 16 and provide proof of your rights, the location of the allegedly infringing content, and the specific remedy requested. I will verify and address the matter as required by law.

9. Third-Party Services

9.1 The App may invoke or display services provided by Apple and other third parties, including PhotoKit, iCloud Photos, MapKit, geocoding, HealthKit, StoreKit, and the App Store. Some App versions may continue to open Feishu online documents. Online documents are also available on a website operated by me.

9.2 Third-party services are independently operated. Their functions, accuracy, continuity, fees, accounts, and data processing are governed by the relevant third party's terms. Maintenance, failures, network or regional restrictions, policy changes, or discontinuation of a third-party service may make some App features temporarily or permanently unavailable. I will provide adaptations or alternatives where reasonably possible, but I cannot control or guarantee the continued availability of a third-party service.

9.3 After you use the system share sheet or open an external link, any transaction, communication, or data-processing relationship with a third party is the legal responsibility of you and that third party. This provision does not exclude any responsibility I must bear by law for my selection, integration, or description of a third-party service.

App Store Special Terms

9.4 You acknowledge that these Terms are entered into between you and the Developer, not between you and Apple. The Developer, not Apple, is responsible for the App and its content.

9.5 The license granted to you under these Terms is limited to use of the App on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms, except to the extent Apple rules permit use through Family Sharing, volume purchasing, or other means.

9.6 The Developer is responsible for providing maintenance and support for the App as required by applicable law. Except as otherwise required by law, Apple has no obligation to provide maintenance or support services for the App.

9.7 If the App fails to conform to an applicable warranty, you may notify Apple in accordance with Apple's rules. Apple may refund any purchase price you paid for the App itself. To the maximum extent permitted by applicable law, Apple has no other warranty obligation regarding the App. The Developer is responsible under these Terms and applicable law for any other liability arising from the App's failure to conform to an applicable warranty.

9.8 The Developer, not Apple, is responsible for addressing claims by you or a third party relating to the App or your possession or use of it, including product liability, legal or regulatory compliance, consumer protection, and similar claims. If a third party claims that the App or your use of the App infringes its intellectual property rights, the Developer is responsible for investigating, defending, settling, or resolving the claim as required by applicable law, except for liability arising from your User Content or unlawful use.

9.9 You must comply with applicable export-control and sanctions laws and represent that you are not located in a country or region subject to a U.S. Government embargo or designated as supporting terrorism and are not listed on any U.S. Government list of prohibited or restricted parties.

9.10 Apple and its subsidiaries are third-party beneficiaries of the App Store Special Terms in these Terms. After you accept these Terms, Apple has the right to enforce these provisions against you as a third-party beneficiary.

9.11 When using the App, you must also comply with applicable third-party agreements, such as your mobile network service agreement, the Apple Media Services Terms, and the terms of any sharing service you actively select.

10. Privacy and Personal Information Protection

10.1 I process relevant information in accordance with the KiroPhotos Privacy Policy and applicable personal information protection laws. The Privacy Policy describes the types of information processed, the purposes and methods of processing, retention periods, third-party services, and the rights available to you.

10.2 The current version does not provide an account system operated by me and does not upload your original photos, videos, face or person-appearance features, photo semantic features, search records, independently recorded footprints, health and workout data, or local indexes to servers operated by me. Apple services, online documents, and Feishu services used by some App versions require network access. See the Privacy Policy for the relevant data flows.

10.3 If you do not agree to optional processing described in the Privacy Policy, you may decline the relevant permission or not use the corresponding feature. If processing is necessary to provide a particular service and cannot reasonably be achieved in another way, the service may be unavailable if you refuse the processing.

10.4 I do not use data obtained or derived from the photo library, face or person-analysis tools, or Apple Health for advertising, marketing, cross-app tracking, or use-based data mining; sell such data; or use person clusters to authenticate identity or establish a natural person's real-world identity. I will not provide this data to a third-party artificial intelligence service without your permission and any other process required by law.

11. Service Changes, Suspension, and Termination

11.1 I may adjust features, interfaces, and methods of providing services due to product planning, technical upgrades, device or system compatibility, changes to third-party services, security risks, laws and regulations, or regulatory requirements.

11.2 General updates that do not materially reduce your existing rights and interests will be communicated through release notes or the App interface. If a change will materially reduce a purchased core entitlement, increase your principal obligations, or have a significant adverse effect on you, I will provide reasonable advance notice through an in-app announcement, purchase screen, or another prominent method and provide any transition, alternative, refund, or other remedy required by law.

11.3 If you materially breach these Terms, use the App for unlawful activity, threaten system or third-party security, or if required by law or a competent authority, I may suspend the relevant service or terminate the software license to the extent permitted by law. Before taking action, I will provide reasonable notice or an opportunity to cure in light of the nature and risk of the violation, except in cases of an urgent security risk, suspected criminal activity, or a legal requirement for immediate action.

11.4 You may stop using and uninstall the App at any time. Back up important data before uninstalling. Stopping use or uninstalling the App does not automatically cancel an App Store subscription; you must continue to manage subscriptions under Section 5 of these Terms.

11.5 The current version does not provide an account system operated by me, so there is no account deletion process. You must manage matters relating to your Apple Account, purchase history, refunds, and subscriptions through channels provided by Apple.

12. Service Disclosures, Assumption of Risk, and Limitations of Liability

12.1 I will make reasonable efforts to maintain the App's security, stability, and functional availability. Due to technical limitations, however, I cannot guarantee that the services will never be interrupted, will be completely error-free, will work on every device, or will meet every particular purpose you may have.

12.2 Face detection, person clustering, person-appearance association, natural-language search, and photo categorization use probabilistic models. They may omit a person, incorrectly merge or split people, return an unrelated photo, or omit a relevant photo. Person names are added by you. A model-generated cluster indicates only similarity among photo features; it does not establish a natural person's real-world identity, family relationship, or other attribute and must not be used for identity authentication or a decision that materially affects another person's rights or interests.

12.3 Photo dates, locations, technical metadata, map places, reverse-geocoding results, natural-language search results, workout routes, and route-derived information may be inaccurate due to source data, device sensors, time zones, mapping services, network conditions, or algorithmic limitations. Workout routes and locally derived distance, pace, and segment information are provided solely for personal photo retrospectives and do not constitute professional surveying, navigation, medical, training, health, or safety advice. Verify results before writing, overwriting, or exporting data or making an important decision based on them.

12.4 The App is not a photo backup service. Device damage, system or app upgrades, insufficient storage, user error, uninstallation, iCloud settings, or third-party service issues may make local data unavailable. You should back up important content using the system photo library, iCloud, a computer, or another reliable method.

12.5 If a service interruption or loss results from force majeure, a telecommunications network failure, a failure of Apple or another third-party service, government action, a cyberattack, or another cause beyond my reasonable control, I will use reasonable efforts to reduce the impact but will not be liable to the extent applicable law does not impose liability on me.

12.6 To the extent permitted by law, I am not liable for indirect losses that could not reasonably have been foreseen or for losses resulting from your breach of these Terms, incorrect operation, failure to make reasonable backups, unauthorized device modification, or use of an unofficial version.

12.7 Nothing in these Terms excludes or limits liability I must bear under law for personal injury or property damage caused intentionally or through gross negligence, or limits any right you have under mandatory laws concerning consumer protection, product quality, personal information protection, or other matters.

12.8 Footprint recording may increase battery use. Location permissions and accuracy settings, signal conditions, battery and storage levels, system background scheduling, and force-quitting the App may cause gaps, drift, delayed updates, or interrupted recording. Route filtering and short-recording retention rules may also change displayed tracks and statistics. The App does not guarantee a complete record of every movement and is not an emergency location, rescue, real-time tracking, or professional navigation service. Do not operate the App while driving or in another situation where doing so would be unsafe.

13. Use by Minors

13.1 If you are under 18 years of age, read these Terms and the Privacy Policy with the guidance of a parent or legal guardian and obtain their consent before using the App or purchasing a paid service.

13.2 If you are under 14 years of age, a parent or legal guardian must read and agree to the Privacy Policy before you use a feature that processes personal information. Parents and legal guardians should supervise minors in cautiously authorizing photo and person recognition, location, and health-data processing and in avoiding the processing or sharing of inappropriate content.

13.3 A minor must obtain a parent or legal guardian's consent before purchasing a paid service and must comply with Apple's age and family purchase rules. A purchase made without guardian consent will be handled under applicable law and Apple's refund process.

14. Changes to These Terms

14.1 I may update these Terms due to changes in laws and regulations, regulatory requirements, business features, pricing models, or third-party services. The updated Terms will be published on the relevant App page and will state a new effective date.

14.2 If a change materially reduces your rights, increases your obligations, or has a significant effect on a paid service, I will notify you through an in-app notice, announcement, or another prominent method and obtain your consent again where required by law.

14.3 If you do not agree to the updated Terms, you may stop using the App and manage your subscription and local data in accordance with these Terms. Purchases completed and rights and obligations lawfully arising before an update do not automatically become invalid because of the update.

15. Governing Law and Dispute Resolution

15.1 The formation, validity, performance, interpretation, and dispute resolution of these Terms are governed by the laws of the mainland of the People's Republic of China, except where mandatory law provides otherwise.

15.2 If a dispute arises from these Terms or the App's services, the parties should first attempt to resolve it amicably using the contact method in Section 16. If consultation fails, either party may bring a claim before a court with jurisdiction in accordance with law. This provision does not prevent a consumer from pursuing a complaint, mediation, arbitration where the parties have separately entered into a valid arbitration agreement, or another remedy provided by law.

16. Miscellaneous and Contact

16.1 Section headings are for convenience only and do not affect interpretation. If any provision is held invalid or unenforceable, the remaining provisions remain effective. The affected provision should be interpreted or adjusted, to the extent permitted by law, in the manner that most closely reflects its original lawful purpose.

16.2 I may provide service-related notices through in-app dialogs, announcements, paid-service screens, or App Store release notes. Because the current version does not provide an account system operated by me, I will not send notices through purported in-app messages or a phone number registered with the App.
